Update following site meeting

Below are the three main options that were considered at the site meeting:

Extinguishing the bridleway and creating a footpath

It seems unlikely that it would be possible to extinguish the bridleway in order to create a footpath in its place as this requires there to be no public need for the bridleway.  Cyclists and horse riders expressed that there is a need.  

Applying for a modification of the definitive map

There was some suggestion at the meeting that the route may have been recorded incorrectly in the first instance and that perhaps the correct route is that currently open and used, having had a ford in place of the bridge prior to the embankment works.  A local resident has agreed to look into the potential for a modification application.  If an individual chooses to pursue this and is successful in proving that the line was incorrectly recorded, a Definitive Map Modification Order may be made by Somerset County Council to alter the definitive map and statement to reflect the correct route.  This is not a simple process - it involves a significant amount of effort in obtaining evidence and witness statements.  This process could take a very long time to be completed.

Reopening the definitive line

If the definitive route is not changed, it will be necessary to reopen the definitive line as it is recorded.  This will require works to remove a wall on/bordering a property and clear the route to rejoin the open section.  In addition to this, it seems likely that public rights have accrued on foot over the current used route to the point where it meets the definitive line of the bridleway and as such the current route would also remain open and could potentially be dedicated or claimed as a public footpath along this section.

Current action

At present, the potential for making an application for modification of the definitive map is being explored.  If, following further investigation, this does not appear to be a viable option, the alternative options will be revisited.
