Article 4 Directions

Certain types of property, or types of applicant, can benefit from permitted development rights to undertake work without the need to apply to the Planning Authority for planning permission. The Planning Portal explains more of the background on permitted development rights . These rights are regularly updated and changed and we are happy to advise in relation to each individual property.
On rare occasions, in the interests of the wider amenity of the area, it is possible for the Local Planning Authority to serve an Article 4 Direction. This removes the permitted development rights in relation to certain types of development on a site. It means a planning application will be required for works that could otherwise take place without the need for a planning application. There are ten Article 4 Directions across the National Park and these are listed below together with the Order and the Map.

Somerset

1) Land at Hartford Lodge, Brompton Regis – (Brompton Regis Parish (6/3)
Ref: The Town and Country Planning General Development Order 1977, as amended.  

The effect of the Direction is to require specific planning permission before carrying out of any building or engineering operation requisite for the use of that land for the purposes of agriculture being development comprised under Class VI, Paragraphs 1, 3 and 4 of the Order within the land edged red on the plan. – Signed and Dated 29 April 1988

2) Land at Allcombe Water, Wellshead Farm, Exford – (Exford Parish 6/13)
Ref: The Town and Country Planning General Development Order 1977, as amended.  

The effect of the Direction is to require specific planning permission before carrying of out any building or engineering operation requisite for the use of that land for the purposes of agriculture being development comprised under Class VI, Paragraphs 1, 3 and 4 of the Order within the land edged red on the plan. – Signed and Dated 20 June 1988

3) Land at Gallon House, Simonsbath – (Exmoor Parish 6/14)
Ref: The Town and Country Planning General Development Order 1973.  

The effect of the Direction is that the land edged red on the plan cannot be used for agricultural development without the permission of the Local Planning Authority.  Any development of the kind specified in paragraph 1 of Class VI of the First Schedule to the 1973 Order. – Signed and Dated 22 February 1974

4) Land at Roosthitchen, Simonsbath - (Exmoor Parish 6/14)

The effect of the Direction is to require specific planning permission for any development of the kind specified in Paragraphs 1 and 2 of Class IV of the First Schedule to the 1977 Order for Temporary Buildings and Uses – Signed and Dated 12 August 1977


5) Land at Pitt Bridge, Timberscombe – (Timberscombe Parish 6/34)

Outside of the National Park:

10) Land at Berrynarbor

Ref: The Town and Country Planning General Development Order 1973. The effect of the Direction is that the permission granted by Article 3 of the said Order shall not apply to any development of Class 1V.2 specified in the First Schedule to the said Order in the area of land within the Barnstaple Rural District shown coloured pink on the plan. – Signed and Dated 05 February 1974.
